TERMS AND CONDITIONS

These Terms & Conditions (“Terms”) govern (a) your enrollment and participation in any course, cohort, workshop, bootcamp, career discovery program, or talent pipeline program offered by INSTY (each a “Program”), and (b) your use of any INSTY website, platform, communities, tools, or services (the “Service”).
By enrolling in a Program, creating an account, making a payment, accessing the Service, or attending any session (online/offline), you agree to these Terms. If you do not agree, do not enroll or use the Service.

Grievance Redressal: We aim to acknowledge grievances within 48 hours and attempt resolution within 30 days.

Definitions

  • You / User / Learner: Any person using the Service and/or enrolling in a Program.

  • Content: Materials provided by INSTY (videos, slides, templates, recordings, frameworks, assessments, resources, branding).

  • Input: Any data/text/images/files you upload or submit.

  • Output: Any content generated on the Service based on your Input (if applicable).

  • Live Brief / Project: Practical work performed during a Program.

Eligibility

You must be 18+, or have written parent/guardian consent. You confirm information you provide is accurate and complete.

PART A — Program Terms

Enrollment & Access

  • Enrollment is confirmed only after successful payment and completion of any screening/verification steps (if applicable).

  • Access to Program materials, communities, and sessions is for personal use only. Credential sharing may result in suspension/removal.

Program Delivery (Hybrid / Online / Offline)

Programs may be delivered in a hybrid format (online + offline), as communicated for the specific batch. INSTY may reasonably modify schedules, venues, instructors/mentors, delivery tools, and content sequence due to operational needs while maintaining intended outcomes.

Code of Conduct

You agree to respectful conduct. Prohibited conduct includes harassment, hate speech, threats, bullying, discrimination, disruption, spamming/solicitation, cheating, plagiarism, impersonation, and misuse of community channels. Violations may lead to removal and loss of access (see Refunds).

Assessments & Integrity

Programs may include assignments, evaluations, attendance requirements, and performance reviews. Integrity violations may result in score cancellation, certificate denial, disqualification from opportunities, or removal.

Recording Policy (Important)

  • Learners may NOT record any session (audio/video/screen) online or offline without prior written permission from INSTY.

  • Unauthorized recording/sharing/reposting/sale is a material breach and may result in removal and legal action.

  • INSTY may record sessions for learner access, quality, training, or internal review unless stated otherwise for a Program.

Intellectual Property (INSTY Content)

All Content is owned by or licensed to INSTY. You receive a limited, personal, non-transferable license to use Content only for learning. You may not copy, distribute, resell, upload, publish, or commercially exploit any Content without written permission.

Live Briefs / Projects — Ownership & Portfolio

Unless INSTY explicitly states otherwise in writing for a specific Program:

  • INSTY owns deliverables/outputs created as part of the Program (drafts + finals).

  • Portfolio use is permitted only after written approval by INSTY and only if it does not reveal confidential information or violate partner/client requirements.

  • INSTY may restrict/revoke portfolio permissions for confidentiality, quality control, partner/client requirements, or IP reasons.

Certificates (If Applicable)

Certificates (if any) may be issued based on completion/performance and verification. INSTY may withhold/revoke certificates for misconduct, integrity violations, or non-payment.

Hiring / Interview Opportunities (“Guaranteed Interviews”)

If a Program advertises “Guaranteed Interviews”:

  • This means INSTY will facilitate interview opportunities for eligible learners, subject to Program criteria (for example: minimum attendance, completion of required work, satisfactory conduct, and any screening criteria communicated).

  • “Interview opportunity” means INSTY will make reasonable efforts to schedule at least one interview/screening interaction through its network or arranged panels.

  • This does not guarantee selection, job offer, compensation, role type, location, start date, or timeline; final decisions rest with employers/partners.

PART B — Payments, Refunds, Transfers

Payments

Fees, applicable taxes (including GST where applicable), and payment schedules will be communicated at the time of enrollment/checkout. If installments are offered and payments are missed, INSTY may pause access until dues are cleared.

Refunds, Cancellations & Transfers

  • No refunds after purchase. Once payment is made and enrollment/access is confirmed, fees are non-refundable, except where required by applicable law.

  • Seat transfers are not allowed.

  • If INSTY cancels a Program entirely and does not provide a reasonable alternative (replacement batch/format), INSTY may issue a refund or credit at its discretion, unless otherwise required by law.

PART C — Service / Platform Terms (Website, Community, Tools, AI Features)

Account Security

If you create an account, you are responsible for maintaining credential confidentiality and all activity under your account.

Input Responsibility

You are solely responsible for your Input and confirm you have the rights/permissions to submit it. You must not upload illegal, infringing, or harmful content.

Output (If Tools/AI Are Offered)

If the Service generates Output:

  • Subject to your compliance, you may use the Output for lawful purposes.

  • Program exception: If Output/deliverables are created as part of a Program/Live Brief, Section 10 applies.

  • Accuracy disclaimer: Output may be inaccurate/incomplete/biased; you should verify independently before relying on it.

Acceptable Use

You agree not to use INSTY to:

  • generate illegal, defamatory, hateful, harassing, or harmful content

  • infringe third-party IP, privacy, or publicity rights

  • reverse engineer, decompile, or attempt to extract source code/models

  • scrape/automate/mass-generate content in a manner that disrupts systems or violates usage limits

  • bypass security or access controls

Third-Party Tools

Programs/Service may use third-party tools (video platforms, messaging apps, cloud tools, payment gateways). Their terms may apply. INSTY is not responsible for third-party outages or changes.

PART D — Privacy, Liability, Termination, Legal

Privacy

INSTY collects and processes personal data for enrollment, delivery, assessments, certification, interview facilitation, communications, support, safety, and compliance, in accordance with applicable Indian laws.

Communications

You consent to receive Program-related communications via email/WhatsApp/SMS/phone. You may opt out of promotional messages; essential Program communications may still be sent.

Disclaimers

Programs and the Service are educational/informational. Outcomes depend on effort, background, and market/employer requirements. No guarantee is made beyond what is explicitly stated in these Terms.

Indemnity

You agree to indemnify and hold harmless INSTY (and its team/partners) from claims, losses, damages, liabilities, and expenses arising out of your (a) breach of these Terms, (b) misconduct, (c) Input you submit, or (d) violation of law or third-party rights.

Limitation of Liability

To the maximum extent permitted by law:

  • INSTY is not liable for indirect/incidental/special/consequential damages (including loss of profits, opportunities, or data).

  • INSTY’s total liability for any claim will not exceed the amount paid by you for the relevant Program/Service giving rise to the claim.

Termination / Suspension

INSTY may suspend or terminate access to the Service and/or Program (including communities/materials) for violations of these Terms, misconduct, integrity issues, credential sharing, or harmful activity. Termination may be immediate where necessary for safety/compliance.

Force Majeure

INSTY is not responsible for delays/failures due to events beyond reasonable control (natural disasters, government actions, strikes, outages, internet disruptions, etc.).

Governing Law & Jurisdiction

These Terms are governed by the laws of India. Courts in Mumbai, Maharashtra shall have jurisdiction.

Miscellaneous

  • Severability: If any provision is unenforceable, the remainder remains effective.

  • Waiver: Failure to enforce a provision is not a waiver.

  • Entire Agreement: These Terms plus any Program-specific written addenda form the entire agreement.

  • Assignment: INSTY may assign its rights/obligations to a successor; you may not transfer your rights without written consent.

  • Updates: INSTY may update these Terms; continued use/enrollment after updates means acceptance

This Privacy Policy explains how INSTY (“INSTY”, “we”, “us”) collects, uses, shares, stores, and protects personal data when you visit our website, use our platform/tools/communities, or enroll in our programs (“Services”). This Policy should be read with our Terms & Conditions.

We process personal data in accordance with applicable Indian laws, including the Digital Personal Data Protection Act, 2023 and notified rules under it, and other applicable IT rules.

C. Transaction & billing data

  • Payment status, transaction reference details, invoices/receipts (note: payments are typically processed by third-party payment processors; we may not store full card/bank details)

D. Content you submit

  • Assignments, project submissions, forms, community posts/messages, files, and any “Input” you upload to our tools (if offered)

E. Technical & usage data

  • Device information, browser type, IP address, approximate location (derived), log data, pages viewed, timestamps, referral URLs, cookies and similar tracking data

F. Audio/visual data (if applicable)

  • Session recordings/photographs where sessions are recorded (as described in our Terms)

We do not intend to collect highly sensitive personal data (e.g., passwords for your other accounts, detailed medical data) unless you voluntarily provide it. Please avoid sharing such information unless specifically requested for a lawful purpose.

  3. Conduct assessments, issue certificates (if applicable), track progress

  6. Improve our Services, troubleshoot issues, prevent fraud/abuse

A. Service providers (Data Processors)

  • Hosting/cloud storage, email/communication tools, analytics, customer support tools, payment processors, and video/meeting tools (to operate and deliver Services). Data fiduciaries remain responsible for processing done on their behalf and are expected to use contracts with processors.

B. Employers/partners (Talent pipeline / interviews)

  • With your participation/eligibility in a program or pipeline, we may share relevant profile details (e.g., resume/portfolio/assessment highlights) with potential employers/partners for interview facilitation and evaluation. We will aim to share only what is necessary for that purpose.

C. Legal and compliance

  • Regulators, courts, law enforcement, or government agencies where required by law or to protect rights/safety.

Cookies & tracking technologies

We use cookies and similar technologies to:

  • Keep the website/platform functional

  • Understand usage and improve performance

  • Measure marketing effectiveness (if applicable)

Data retention

We retain personal data only for as long as necessary for the purposes described in this Policy, including:

  • Delivering Services and supporting users

  • Maintaining records for legal, tax, accounting, and dispute resolution needs

Children’s data

Our Services are generally intended for individuals 18+. Cross-border transfers

We may store/process personal data using service providers located in India or other jurisdictions. Where cross-border transfer restrictions apply, we will follow applicable legal requirements and safeguards.

Third-party links

Our Services may contain links to third-party websites or tools. Their privacy practices are governed by their own policies. INSTY is not responsible for third-party privacy practices.

INSTY — Data Deletion / Account Deletion Request

This page explains how you can request deletion of your INSTY account and/or personal data. This process applies to users of INSTY’s website, platform, tools, communities, and programs (“Services”).

What you can request

You may request one of the following:

A. Delete my INSTY account
Deletion of your account and associated profile data on INSTY systems.

B. Delete specific personal data
Examples: phone number, email marketing contact, profile details, uploaded documents (where applicable).

C. Delete data linked to a specific service/program
Examples: community data, tool inputs/outputs (if applicable), or program application data.

How to request deletion

  2. Registered Email Address (used on INSTY)

  3. Registered Phone Number (if provided)

  4. Request Type (Account deletion / Specific data deletion)

  5. What you want deleted (be specific if requesting partial deletion)

  6. Reason (optional)

Verification: We may ask you to verify ownership (e.g., request sent from your registered email or a one-time verification step). We do this to prevent unauthorized deletions.

Requests via nominee/authorized person: If a nominee/authorized person is making the request, we may ask for reasonable proof of authorization before processing.

What “deletion” means

Depending on the category of data and legal/operational requirements, deletion may mean:

  • Permanent deletion from active systems, and/or

  • De-identification/anonymization so data can no longer be linked to you, and/or

  • Restriction of processing (where deletion is not possible immediately due to backups or legal retention)

Timelines

  • We aim to acknowledge your request within 48 hours.

  • We aim to complete the request within 30 days, subject to verification and lawful retention requirements.

If we need more information, we will contact you using the email address you provided.

What we may retain (legal and operational reasons)

Even after deletion, INSTY may retain limited information where required or permitted by law or for legitimate purposes, such as:

  • Invoices/receipts and accounting/tax records

  • Compliance records (as required by applicable law)

  • Fraud prevention and security logs

  • Dispute resolution / enforcement of Terms

  • Audit trails (limited access, restricted use)

Where retained, the data will be stored securely and only for as long as required for the above purposes.

Third-party platforms

Some Services may use third-party platforms (e.g., payment processors, video platforms, messaging tools). We can delete data from our systems and request deletion from providers where feasible, but we may not control or be able to delete data stored solely by third parties. You may also need to contact those third parties directly.

What deletion may affect

Deleting your account/data may result in:

  • loss of access to your profile, community groups, stored materials, and progress records

  • loss of access to prior submissions or history

  • inability to re-access certificates/verification (if any), unless certificate/verification records must be retained for compliance or verification

If you are currently enrolled in an ongoing Program, deleting your account may impact your ability to participate.
